DELIVERY Terms & Conditions
These terms and conditions set out the basis on which Northern Diver (“we”, “us”, “our”) provides delivery services for goods purchased by you (“you”, “your”, “the customer”). They outline our responsibilities, your obligations, and our respective rights in the unlikely event that things go wrong. Please read these terms carefully before placing an order.
1. Our Contract with You
1.1 When you place an order for goods with Northern Diver, a contract is formed between you and Northern Diver for the supply of those goods.
1.2 Delivery of goods is carried out through trusted courier partners such as UPS, DPD, and Royal Mail (the “courier”). Northern Diver engages these services on your behalf to fulfil delivery.
1.3 Once goods have been collected by the courier, all liability for loss, damage, or delay in delivery passes from Northern Diver to the courier to the fullest extent permitted by law. You will be provided with tracking details and instructions on how to monitor your delivery.
2. Your Responsibilities
2.1 You must ensure that all delivery information provided to us is complete and accurate, including:
> The full delivery address;
> The recipient’s name;
> A valid contact phone number and email address.
2.2 Any error or omission in these details may result in delay, non-delivery, or the parcel being returned. Northern Diver accepts no liability for issues arising from incorrect or incomplete information.
3. Compensation and Liability
3.1 It is your responsibility to select the appropriate delivery service and level of insurance coverage based on the value of your goods.
3.2 If the value of your parcel exceeds the courier’s standard liability limit, you do so at your own risk unless you purchase Additional Delivery Insurance at the time of order.
3.3 Northern Diver does not accept liability for any loss, damage, or late delivery once the parcel is in the possession of the courier, except where:
(a) you can demonstrate to our reasonable satisfaction that the goods were undamaged prior to collection; and
(b) loss or damage occurred as a direct result of Northern Diver’s negligence while the goods were still under our control
3.4 In such limited cases, our liability shall not exceed the lesser of:
(a) £20 per parcel; or
(b) the cost of repairing or replacing the goods (as reasonably determined by us).
3.5 If you have purchased courier Additional Delivery Insurance, our liability will be limited to the lesser of:
(a) the amount of insurance purchased; or
(b) the cost of repairing or replacing the goods, up to a maximum of the price paid for them.
3.6 Nothing in these terms affects your statutory rights, or limits our liability for:
(a) death or personal injury resulting from our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any breach of your rights under applicable consumer protection laws.
4. Delivery Estimates
4.1 Estimated delivery times are provided at the point of purchase. These are for guidance only and are not guaranteed.
4.2 You will receive a tracking number via email or SMS once your parcel has been dispatched. Tracking updates are provided by the courier.
5. Delivery Attempts and Proof of Delivery
5.1 Delivery services commence once the courier collects your goods from Northern Diver’s premises.
5.2 If the courier is unable to deliver your parcel to the address provided, they may: (a) attempt redelivery; or (b) return the parcel to Northern Diver.
5.3 Delivery is deemed complete when:
The courier records a “delivered” tracking event; or
The courier provides photographic or signed proof of delivery at the address, a neighbour’s address, or a designated safe place; or
A delivery notification is issued to the recipient.
5.4 For international deliveries, a recorded “delivered” status in the courier’s tracking system constitutes proof of delivery.
6. Claims and Complaints
6.1 If you wish to make a claim for loss, damage, or late delivery, you must notify us in writing within:
28 days (for UK deliveries); or
45 days (for international deliveries) of the date of dispatch.
6.2 To make a claim, please contact us via the methods listed on our Contact Us page. We will provide a Claim Form to be completed and returned within 14 days.
6.3 You may be required to provide supporting evidence, including:
Photographs of damage or defects;
Proof of purchase or receipts;
Repair or replacement cost estimates;
Details of parcel dimensions, weight, and contents.
6.4 Claims will be investigated in cooperation with the courier. Failure to provide adequate information may result in the claim being declined.
7. Customs, Duties, and Taxes
7.1 For international deliveries, you (or the recipient) are responsible for payment of all applicable customs duties, import taxes, and local charges.
7.2 Northern Diver is not liable for any such charges or delays arising from customs processes.
7.3 By placing an international order, you authorise Northern Diver and/or the courier to act as your agent for the purposes of:
(a) liaising with customs authorities;
(b) providing required shipment documentation; and
(c) paying any applicable duties, tariffs, or taxes on your behalf (if requested).
7.4 Any such payments or penalties incurred may be charged to you or the recipient.
7.5 We are not liable for any delays, loss, or damage resulting from customs inspections or actions of government authorities.
8. Charges and Payment
8.1 Delivery charges will be confirmed at checkout. You agree to pay the correct charges for the service selected.
8.2 We reserve the right to adjust charges if parcel dimensions or weights are found to differ from those declared.
8.3 Payment of applicable customs or import charges is the responsibility of the customer or recipient.
9. Right of Lien
9.1 If you owe Northern Diver any outstanding payment, we reserve the right to retain possession of your goods until full payment is received.
9.2 If payment remains outstanding after 28 days, we may dispose of or sell the goods. Proceeds (if any) will be applied to the amount owed and related costs.
10. Events Beyond Our Control
10.1 Northern Diver will not be liable for delay, loss, or damage caused by events outside our reasonable control, including (but not limited to):
Adverse weather;
Pandemic or epidemic;
Industrial action;
Mechanical failure;
Customs delays;
Traffic congestion; or
Failures of third-party courier services.
11. Data Protection
11.1 When you place an order, you provide personal data to Northern Diver. We will process your data in accordance with our Privacy Policy, available on our website.
11.2 By placing an order, you consent to our processing of your data for the purpose of fulfilling your order, including sharing relevant details with our courier partners.
12. Legal Terms
12.1 If any part of these terms is found unenforceable by a court, the remaining provisions shall continue in full force.
12.2 These terms represent the entire agreement between Northern Diver and you in relation to delivery of goods.
12.3 This contract shall be governed by and construed in accordance with English law, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12.4 References to legislation in these terms refer to the latest version in force.
12.5 Any variation to these terms must be agreed in writing by Northern Diver.
